Welcome to Daily Gaming. These Terms of Service ("Terms") govern your use of the Daily Gaming platform, website, and related services operated by Daily Gaming LLC ("Daily Gaming", "we", "our", or "us").

By accessing or using the Daily Gaming platform you agree to these Terms. If you do not agree with these Terms you may not use the platform.

1. Overview of the Platform

Daily Gaming is a competitive skill-based video game platform that allows users to participate in head-to-head matches and tournaments using popular sports video games such as Madden, NBA 2K, College Football, and EA Sports FC.

Match outcomes are determined solely by the actual gameplay results and the skill of the players participating.

Daily Gaming does not offer gambling, betting, casino games, fantasy sports wagering, or games of chance.

2. Eligibility

To use Daily Gaming you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Comply with all applicable laws in your jurisdiction

Daily Gaming reserves the right to verify the identity and age of users at any time and may suspend accounts that fail verification.

3. Account Registration

Users may be required to create an account to access certain features of the platform.

You agree that:

• Information provided during registration is accurate
• You will maintain the confidentiality of your account credentials
• You are responsible for all activity occurring under your account

Daily Gaming reserves the right to suspend or terminate accounts that violate these Terms.

4. Skill-Based Competition

Daily Gaming operates as a skill-based competitive gaming platform.

Winners of contests are determined exclusively by the gameplay results of the participants. No element of randomness, chance, or betting determines match outcomes.

5. Platform Wallet and Payments

Daily Gaming may provide users with a platform wallet that allows users to deposit funds, participate in contests, and withdraw available balances.

Users acknowledge that:

• Funds deposited into the platform may be used for contest participation
• Platform service fees may apply
• Withdrawal requests may require identity verification
• Deposited funds are subject to a 24-hour hold period before they may be withdrawn. This hold applies only to deposited funds. Winnings earned through contest participation are not subject to this hold and may be withdrawn at any time.
• Withdrawal requests may be delayed or denied during fraud review

Daily Gaming uses third-party payment processors to facilitate deposits and withdrawals. Daily Gaming does not store full payment card information.

6. Chargebacks and Payment Disputes

Initiating a chargeback or fraudulent payment dispute with your bank or card issuer in connection with a deposit made on this platform is strictly prohibited.

If a chargeback or payment dispute is initiated, Daily Gaming reserves the right to:

• Immediately and permanently ban the associated account
• Reverse the disputed deposit amount from the user's platform wallet balance
• Flag the user's device information to prevent new account creation
• Take any additional action necessary to recover losses or protect the platform

If you believe a deposit was made in error, contact Daily Gaming support before initiating a dispute with your payment provider.

7. Prohibited Activities

Users may not engage in the following activities:

• Cheating, exploiting, or manipulating gameplay outcomes
• Using automated scripts, bots, or unauthorized software
• Harassing or abusing other players
• Attempting to manipulate contest results
• Creating multiple accounts to circumvent a ban or gain unfair advantages
• Initiating fraudulent chargebacks or payment disputes against deposits made on this platform
• Violating platform rules or applicable laws

Accounts engaging in prohibited activities may be permanently suspended.

8. Contest Rules

Specific contests may include additional rules such as:

• Game format
• Match timing requirements
• Result submission procedures
• Dispute resolution processes

By entering a contest users agree to comply with those rules.

9. Disputes and Match Verification

Daily Gaming may use automated systems and manual review processes to verify match outcomes and resolve disputes between players.

Decisions made by Daily Gaming regarding disputes are final.

10. Service Availability

We do not guarantee uninterrupted access to the platform. Features and services may be updated, modified, or temporarily unavailable from time to time.

11. Intellectual Property

All platform content including logos, branding, software, and platform design are owned by Daily Gaming LLC and protected by intellectual property laws.

Users may not copy, distribute, or reproduce platform content without written permission.

12. Limitation of Liability

To the maximum extent permitted by law, Daily Gaming shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform.

Use of the platform is at the user's own risk.

13. Termination

Daily Gaming reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Upon termination for fraud, abuse, or chargeback activity, Daily Gaming may:

• Permanently ban the account with no right of reinstatement
• Record device information (including IP address) associated with the banned account to prevent the creation of new accounts from the same device or network
• Reverse any wallet balance attributable to disputed or fraudulent deposits

14. Changes to Terms

Daily Gaming may update these Terms periodically. Continued use of the platform after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.
